Terms, policies and agreements that apply to IDONCLOUD services.
These Terms of Service govern the services provided by IDON DIGITAL SOLUTIONS, UNIPESSOAL LDA, operating under the IDONCLOUD brand (“IDONCLOUD”, “we”, “us”, or “our”).
By ordering, accessing, or using our services, you agree to these Terms of Service.
By purchasing or using any IDONCLOUD service, you confirm that you have read, understood, and agreed to these Terms of Service, together with any policies applicable to the service.
If you are acting on behalf of a company or other legal entity, you confirm that you have authority to accept these Terms on its behalf.
If you do not agree with these Terms, you must not order or use our services.
IDONCLOUD provides hosting, cloud and IT infrastructure services, including, where available:
IDONCLOUD operates network resources under AS200859.
Individual services may be delivered through infrastructure owned or operated by IDONCLOUD or through selected datacenters, carriers, upstream providers, and other third-party suppliers.
The specifications, location, bandwidth, hardware and features applicable to a service are those stated in the relevant order or service description.
Customers are responsible for all content, applications, software, traffic and activities originating from their services.
Customers must keep account credentials secure and provide accurate and current account and billing information.
Our services must not be used for unlawful or abusive activities, including fraud, phishing, spam, malware distribution, unauthorized system access, deliberate network attacks, intellectual property infringement, or other activities prohibited by applicable law or our Acceptable Use Policy.
Customers are responsible for maintaining independent backups of important data unless a specific service expressly includes a managed backup service.
All orders are subject to acceptance, availability, payment confirmation and, where appropriate, security, fraud or identity verification.
An order is not guaranteed to be accepted merely because payment has been submitted.
Provisioning times are estimates unless expressly guaranteed.
Dedicated servers, custom hardware, IP resources, colocation and other customized infrastructure may require additional provisioning time.
Customers must pay all invoices by their stated due date.
Applicable taxes, including VAT where required, will be charged according to applicable law and the information provided by the Customer.
Recurring services renew according to their applicable billing cycle until cancelled.
Failure to pay an invoice may result in suspension or termination of the affected service.
Customers are responsible for ensuring that their billing and tax information is accurate.
Customers may request cancellation through the IDONCLOUD client area or another cancellation method made available by us.
Unless otherwise specified, cancellation takes effect at the end of the current paid billing period.
Services continue to renew until a valid cancellation request has been submitted.
Customers requesting immediate termination should ensure that all required data has been backed up beforehand. Data associated with a terminated service may be permanently deleted.
Where the Customer qualifies as a consumer under applicable Portuguese or European Union law, statutory consumer rights remain unaffected by these Terms.
Consumers entering into a distance contract may have a statutory right to withdraw from the contract within 14 days, subject to the conditions and exceptions established by applicable law.
Where a consumer expressly requests that service provision begin during the withdrawal period, the consumer may be required to pay an amount proportionate to the services already provided if the right of withdrawal is subsequently exercised.
Where permitted by applicable law, the right of withdrawal may cease after a service has been fully performed where performance began with the consumer's prior express consent and acknowledgement of the applicable consequences.
Dedicated hardware, custom configurations, specifically procured resources and other services prepared according to individual Customer requirements may be subject to additional conditions and applicable statutory exceptions.
Outside mandatory statutory rights or a specific refund guarantee expressly offered by IDONCLOUD, fees already incurred for activated services, setup, licences, IP resources, bandwidth, custom work or third-party resources are generally non-refundable.
VPN 30-Day Money-Back Guarantee: first-time purchases of the IDONCLOUD VPN service may be refunded in full if requested within 30 days of the initial payment, by ticket or email to [email protected]. Refunds are made to the original payment method. The guarantee applies once per customer, does not apply to renewals, and does not apply where the service was used in breach of our Acceptable Use Policy. Dedicated servers and other services are not covered by this guarantee.
Nothing in this section limits any mandatory consumer right that cannot legally be waived.
Customers must comply with the IDONCLOUD Acceptable Use Policy and all applicable laws.
Where we receive a credible abuse complaint, we may notify the Customer and request corrective action.
Depending on the severity and urgency of the incident, IDONCLOUD may suspend, restrict or terminate an affected service.
Immediate action may be taken where necessary to protect our network, other customers, upstream providers or third parties, or where required by law or a competent authority.
Repeated abuse may result in termination of service.
IP addresses assigned as part of a service do not become the property of the Customer.
IDONCLOUD or the relevant resource provider may replace or withdraw assigned IP addresses where reasonably necessary for technical, operational, contractual, security or regulatory reasons.
Customers using their own ASN, IP prefixes or other network resources must maintain the necessary rights and authorizations to use those resources.
Bandwidth and port speeds are provided according to the purchased service specification.
Where a service is described as “unmetered”, this refers to the absence of a fixed data-transfer allowance and does not guarantee unlimited physical network capacity.
IDONCLOUD aims to provide reliable and stable services.
However, uninterrupted availability cannot be guaranteed unless expressly covered by a separate Service Level Agreement.
Maintenance, hardware failures, upstream network incidents, DDoS attacks, software failures, datacenter incidents and circumstances outside our reasonable control may temporarily affect service availability.
Where reasonably possible, planned maintenance affecting services will be communicated in advance.
Network-level DDoS mitigation is included with IDONCLOUD dedicated servers. Mitigation is provided on a best-effort basis and does not guarantee protection against every attack; attacks that exceed the mitigation capacity remain subject to the limitations in this section.
Customers are responsible for maintaining appropriate independent backups of their data unless their purchased service expressly includes backup management.
IDONCLOUD does not guarantee recovery of data following hardware failure, corruption, compromise, cancellation, suspension or termination.
Customers should not use a single IDONCLOUD server or storage system as the only copy of critical data.
IDONCLOUD may suspend or terminate services where reasonably necessary due to:
Where appropriate and reasonably possible, the Customer will be given an opportunity to correct a violation before permanent termination.
Serious security, abuse or legal incidents may require immediate action without prior notice.
Some services rely on third-party datacenters, carriers, upstream providers, hardware suppliers, software vendors, payment processors or other service providers.
IDONCLOUD cannot guarantee the uninterrupted operation of systems outside its reasonable control.
The use of certain third-party products may also be subject to the relevant provider's licence terms or conditions.
To the maximum extent permitted by applicable law, IDONCLOUD will not be liable for indirect or consequential losses arising from service interruption, data loss, unauthorized access, third-party failures or use of the services.
Customers are responsible for determining whether a service is appropriate for their intended use and for implementing appropriate redundancy, security and backup measures.
Nothing in these Terms excludes or limits liability, statutory warranties or consumer rights where such exclusion or limitation is prohibited by applicable law.
Personal data is processed in accordance with the IDONCLOUD Privacy Policy and applicable data-protection legislation, including the GDPR where applicable.
Customers are responsible for ensuring that personal data they process using IDONCLOUD infrastructure is handled in accordance with applicable law.
IDONCLOUD may update these Terms to reflect changes in our services, infrastructure, supplier requirements, security practices or applicable law.
Where required by law or appropriate considering the nature of a material change, Customers will be notified in advance.
The current version of these Terms will be published on the IDONCLOUD website.
These Terms are governed by the laws of Portugal.
For consumers, this choice of law does not deprive them of mandatory protections that apply under the laws of their country of habitual residence where applicable.
Any dispute will be submitted to the competent jurisdiction determined in accordance with applicable law.

Security, access and abuse-related records may be retained for an appropriate period based on their purpose, legal requirements and security considerations.
When personal data is no longer required, it will be deleted, anonymised or otherwise handled in accordance with applicable law.

Customers are responsible for ensuring that their users, employees, customers, applications and systems comply with this AUP.
IDONCLOUD services may only be used for lawful purposes.
Customers must not use, attempt to use, or allow IDONCLOUD services to be used in a manner that:
Customers remain responsible for activity originating from their services, including activity performed by third parties who have obtained access to those services.
Customers must not knowingly distribute, host, operate or facilitate:
Compromised servers must be secured promptly after notification.
The use of IDONCLOUD services for phishing, credential theft, financial fraud, scams, deceptive impersonation or other fraudulent activities is prohibited.
Confirmed phishing or actively malicious services may be suspended immediately where necessary to prevent ongoing harm.
Customers must not use IDONCLOUD services to gain or attempt to gain unauthorized access to systems, accounts, networks or data.
Prohibited activities include unauthorized exploitation of vulnerabilities, password attacks, credential stuffing and unauthorized system compromise.
Legitimate security testing is permitted only where the Customer has authorization from the owner of the systems being tested and the activity does not negatively affect IDONCLOUD infrastructure or third parties.
Large-scale, aggressive or unauthorized network scanning is prohibited where it creates abuse complaints, security risks or disruption.
Legitimate scanning and security research must be conducted responsibly and only against systems for which the Customer has appropriate authorization.
IDONCLOUD services must not be used to originate, coordinate, facilitate or participate in denial-of-service or distributed denial-of-service (DDoS) attacks.
Systems compromised and used to participate in such attacks may be restricted or suspended until secured.
Sending unsolicited bulk email (“spam”) through IDONCLOUD services is prohibited.
Customers must not use IDONCLOUD infrastructure for:
Legitimate transactional and opt-in marketing email is permitted provided that the sender complies with applicable law and appropriate consent and unsubscribe requirements.
Customers operating mail servers are responsible for securing them against unauthorized relay and abuse.
Customers must not knowingly engage in activities that cause IDONCLOUD IP addresses or network ranges to be listed on major abuse, spam or security blocklists.
Where an assigned IP address develops a poor reputation as a result of Customer activity, IDONCLOUD may require the Customer to resolve the cause before considering replacement of the IP address.
Repeated requests for replacement IP addresses intended to bypass blocklists or abuse controls may be refused.
Customers must respect applicable copyright, trademark and other intellectual property laws.
IDONCLOUD may process valid copyright or intellectual property complaints concerning content hosted on its infrastructure.
Where appropriate, we may forward a complaint to the affected Customer and provide a reasonable opportunity to investigate and resolve the matter.
Repeated or serious infringement may result in restriction, suspension or termination.
Submitting false or misleading infringement complaints is prohibited.
Customers must not knowingly use IDONCLOUD services to store, distribute, publish or facilitate content that is unlawful under applicable law.
Where IDONCLOUD receives a valid legal order or becomes aware of content that must legally be removed or restricted, appropriate action may be taken.
Where legally permitted and operationally appropriate, the Customer may be notified and given an opportunity to respond.
The use of IDONCLOUD services for child sexual abuse material (CSAM) or other unlawful sexual exploitation of minors is strictly prohibited.
Credible reports involving such material may result in immediate restriction or suspension and may be reported to the appropriate competent authorities where required or permitted by law.
Customers must not intentionally generate traffic designed to disrupt, degrade or overwhelm third-party networks or services.
Where inbound or outbound traffic threatens the stability or security of IDONCLOUD infrastructure, IDONCLOUD may implement protective measures including:
Such measures may be applied without prior notice where immediate action is reasonably necessary to protect infrastructure.
Customers must not intentionally use services in a manner that materially and persistently interferes with shared infrastructure or other customers.
Where excessive resource consumption creates operational problems, IDONCLOUD may contact the Customer to identify an appropriate solution.
Dedicated resources may be used up to the technical and contractual limits of the purchased service.
Customers may use the bandwidth included with their purchased service for legitimate purposes.
Where a service is advertised as unmetered, this means that no fixed monthly data-transfer quota is applied unless otherwise stated.
“Unmetered” does not mean unlimited physical capacity. Traffic remains subject to the contracted port speed, network availability, technical limitations and this AUP.
IDONCLOUD may investigate abnormal traffic patterns associated with attacks, compromised systems or prohibited activity.
Legitimate proxy, VPN and privacy-related services are permitted unless otherwise specified for a particular product or location.
Customers operating such services remain responsible for responding appropriately to credible abuse reports associated with their infrastructure.
VPN or proxy services must not be knowingly operated for the primary purpose of facilitating unlawful or abusive activity.
Customers are responsible for securing publicly accessible services.
Open proxies, open relays, unsecured databases, DNS resolvers and other services that can be abused by third parties should be appropriately secured.
Where an insecure service is actively causing abuse, IDONCLOUD may temporarily restrict access until the issue is resolved.
Legitimate cryptocurrency-related applications and computational workloads may be permitted where they comply with the service specifications and applicable law.
Unauthorized cryptocurrency mining, compromised mining activity or workloads that violate applicable resource, power or infrastructure limits are prohibited.
Individual products or datacenters may impose additional restrictions.
IRC services, game servers, streaming applications and other high-traffic services may be permitted unless prohibited by the applicable product description, datacenter or upstream provider.
Such services remain subject to this AUP and applicable network limitations.
Customers are responsible for maintaining the security of their operating systems, applications, passwords and services.
Customers should:
A compromised server does not automatically imply intentional abuse. However, Customers are expected to take reasonable corrective action once notified.
Abuse reports concerning IDONCLOUD infrastructure should be sent to:
Reports should include sufficient information to identify and investigate the activity, such as:
Incomplete or clearly automated complaints without sufficient information may require additional details before action can be taken.
Where reasonably appropriate, IDONCLOUD generally seeks to resolve abuse issues by notifying the affected Customer and requesting corrective action.
Depending on the circumstances, our response may include:
The appropriate response depends on the severity, credibility, urgency and recurrence of the incident.
IDONCLOUD does not guarantee advance notice where immediate intervention is necessary to protect users, infrastructure, third parties or comply with law.
Repeated abuse incidents associated with the same Customer, service or account may result in stronger enforcement measures.
A Customer who repeatedly fails to address legitimate complaints may have affected services suspended or terminated.
Deliberately moving prohibited activity between IP addresses or servers to evade enforcement is itself a violation of this AUP.
IDONCLOUD may take immediate action without prior notice where reasonably necessary in cases involving:
Where appropriate and legally permitted, the Customer will subsequently be informed of the action taken.
IDONCLOUD operates infrastructure through multiple networks, datacenters and service providers.
Certain locations or products may therefore be subject to additional reasonable restrictions imposed by the applicable datacenter, carrier or upstream provider.
Where such a restriction affects a Customer, IDONCLOUD will seek to communicate the relevant requirement where reasonably possible.
A violation of this AUP may result in warning, restriction, suspension or termination depending on its severity and circumstances.

Nothing in this AUP requires IDONCLOUD to maintain a service where doing so would violate applicable law or create a serious security or operational risk.
IDONCLOUD may update this Acceptable Use Policy to reflect changes in applicable law, security threats, network requirements, infrastructure providers or our services.
The current version will be published on the IDONCLOUD website.

This Domain Registration Agreement (“Agreement”) applies to domain name registration, renewal, transfer and related domain services provided by IDON DIGITAL SOLUTIONS, UNIPESSOAL LDA, operating under the IDONCLOUD brand (“IDONCLOUD”, “we”, “us”, or “our”).
This Agreement supplements the IDONCLOUD Terms of Service and Acceptable Use Policy.
By registering, transferring, renewing or managing a domain name through IDONCLOUD, you (“Registrant”, “Customer”, “you”, or “your”) agree to this Agreement and to any applicable rules, policies and requirements of the relevant registrar, registry operator and, where applicable, ICANN.
IDONCLOUD may provide domain registration services directly or through third-party accredited registrars, registry operators or other domain service providers.
Registration of a domain name is subject to availability and acceptance by the applicable registry and registrar.
Submitting and paying for a domain order does not guarantee successful registration.
A domain is considered successfully registered only after registration has been confirmed by the applicable registrar or registry.
You must provide accurate, complete and current information when registering or transferring a domain name.
Depending on the applicable domain extension and registry requirements, this information may include:
You are responsible for keeping this information accurate throughout the registration period.
Providing false, misleading or materially incomplete information may result in suspension, cancellation or other action where permitted or required by the applicable registrar, registry or domain policy.
A domain name displayed as available is not guaranteed to remain available until registration has been successfully completed by the applicable registry.
Domain availability may change between the time of search, order, payment and registration.
IDONCLOUD is not responsible for the loss of a domain where another party registers it before our registration request has been successfully completed.
If a paid domain registration cannot be completed, IDONCLOUD will normally refund or credit the applicable domain registration charge, subject to the circumstances and payment method.
Domain names are registered for the period selected during ordering and permitted by the applicable registry.
Registration does not give the Registrant permanent ownership of a domain name.
The Registrant receives the right to use the domain for the applicable registration period, subject to this Agreement and the rules of the relevant registrar and registry.
The Registrant is responsible for ensuring that domain names are renewed before expiration.
Where automatic renewal is enabled, IDONCLOUD may attempt to renew the domain and charge the applicable renewal fee using the available account balance or authorised payment method.
Automatic renewal is not a guarantee that a domain will be successfully renewed.
Customers remain responsible for monitoring domain expiration dates, maintaining valid payment information and ensuring that renewal invoices are paid on time.
If a domain is not renewed before its applicable deadline, the domain may expire and associated websites, email and other services may stop functioning.
After expiration, the domain may enter one or more lifecycle stages determined by the applicable registry or registrar.
These may include:
The availability and duration of these stages vary between domain extensions.
IDONCLOUD cannot guarantee recovery of an expired domain.
Some expired domains may enter a redemption period during which restoration is possible for an additional fee.
Redemption or restoration fees are determined by the applicable registry, registrar and/or IDONCLOUD and may be substantially higher than a normal renewal fee.
Payment of a restoration fee does not guarantee recovery until the restoration has been successfully completed.
Customers may request eligible domain names to be transferred to or from IDONCLOUD.
Transfers are subject to applicable registrar, registry and ICANN rules.
A transfer may require:
Certain domains may not be transferable during restricted periods or while subject to a dispute, lock, hold or other applicable restriction.
IDONCLOUD cannot override restrictions imposed by the relevant registrar or registry.
Where available and legally or contractually permitted, eligible Customers may request the authorization/EPP code necessary to transfer a domain to another provider.
The Customer is responsible for protecting authorization codes from unauthorized disclosure.
IDONCLOUD may perform reasonable security verification before releasing sensitive domain-management credentials.
Certain domain registrations may require verification of the Registrant's email address or other contact information.
Failure to complete mandatory verification within the required period may result in suspension of the domain by the registrar or registry.
The Customer is responsible for monitoring the email address associated with the domain and completing required verification procedures.
The Registrant is responsible for ensuring that the registration and use of a domain name:
IDONCLOUD does not determine whether a requested domain infringes a trademark or other third-party right before registration.
Domain names may be subject to dispute-resolution procedures established by ICANN, registry operators, national authorities or other competent bodies.
Depending on the domain extension, this may include the Uniform Domain Name Dispute Resolution Policy (“UDRP”) or another applicable dispute-resolution procedure.
Customers agree to comply with dispute decisions and procedures that are binding under the applicable domain registration rules.
IDONCLOUD may lock, suspend, transfer or otherwise take action concerning a domain where required by a valid decision, applicable policy, registry, registrar, court or competent authority.
Domains registered through IDONCLOUD must not knowingly be used for:
IDONCLOUD may report or escalate serious domain abuse to the relevant registrar or registry where appropriate.
A domain may be suspended, locked, redirected, cancelled or transferred where required by:
Where reasonably possible and legally permitted, IDONCLOUD will inform the affected Customer of material action concerning a domain.
Where IDONCLOUD provides DNS management, Customers are responsible for configuring DNS records correctly unless DNS management is expressly included as a managed service.
Changes to DNS records may require time to propagate across the Internet due to DNS caching and TTL values.
IDONCLOUD does not guarantee immediate global propagation of DNS changes.
Domain registration may require personal or organisational information to be supplied to the applicable registrar and registry.
The publication or disclosure of registration data is governed by applicable law and the policies of the relevant registrar, registry and ICANN.
Where privacy or proxy registration services are available, their use may be subject to additional conditions and may not be available for every domain extension.
Personal data is otherwise processed in accordance with the IDONCLOUD Privacy Policy.
Each top-level domain (“TLD”) may have its own eligibility requirements, registration restrictions, renewal procedures, dispute policies and other rules.
By registering a domain, the Customer agrees to comply with the rules applicable to that domain extension.
Some country-code domains (“ccTLDs”) may require local presence, identification, documentation or other eligibility requirements.
Some domain names may be classified as premium domains by the applicable registry or registrar.
Premium domains may have higher registration, renewal, transfer or restoration prices than standard domains.
Prices displayed during an initial availability search may occasionally differ from the final registry price.
Where a material pricing difference is identified before registration, the Customer may be required to approve and pay the applicable amount before the registration proceeds.
Domain registration, renewal, transfer and redemption fees generally become non-refundable once the applicable transaction has been successfully submitted or completed, except where otherwise required by applicable law.
A successfully registered or renewed domain cannot normally be returned or cancelled in the same manner as an unused hosting service because the registration creates an external registry transaction.
If IDONCLOUD is unable to complete a new domain registration, the applicable registration charge will normally be refunded or credited.
Nothing in this section limits mandatory consumer rights under applicable law.
Domain prices may change as a result of registry, registrar, currency, tax or other supplier price changes.
Renewal pricing may therefore differ from the original registration price.
The price applicable to a renewal is the applicable renewal price at the time the renewal transaction is due or processed, subject to any mandatory notice requirements.
The Registrant identified in the applicable registration records is generally treated according to the applicable registrar and registry rules as the holder of the registration rights.
Customers are responsible for securing their IDONCLOUD account, email account, domain credentials and authentication methods.
IDONCLOUD is not responsible for unauthorized domain changes resulting from compromised Customer credentials where the compromise was outside IDONCLOUD's reasonable control.
Customers should enable additional account security measures where available.
IDONCLOUD may act as a reseller or intermediary for domain services supplied by third-party registrars and registries.
Certain domain operations are therefore outside IDONCLOUD's direct technical control.
IDONCLOUD is not responsible for registry or registrar outages, processing delays, policy changes or actions outside our reasonable control, subject to rights that cannot be excluded under applicable law.
To the maximum extent permitted by applicable law, IDONCLOUD is not liable for indirect or consequential loss arising from:
Nothing in this Agreement excludes or limits liability or consumer rights where such exclusion or limitation is prohibited by applicable law.
IDONCLOUD may update this Agreement to reflect changes in domain policies, registrar or registry requirements, ICANN requirements, applicable law or our domain services.
The current version will be published on the IDONCLOUD website.
Where appropriate or legally required, material changes will be communicated to affected Customers.
This Agreement is governed by the laws of Portugal, subject to mandatory rights and protections applicable to consumers.
